Boost Acquire - Terms of Service

These Terms govern access to and use of Boost Acquire, the Meta advertising lead-generation platform provided by Boost Digital Ltd, trading as Boost AI ("Boost AI", "we", "us"). By signing up for, paying for, or using Boost Acquire, you ("Customer", "you") agree to these Terms.

1. Acceptance of Terms

Making payment, submitting a signup form, or using any part of Boost Acquire constitutes acceptance of these Terms in full. If you do not agree, do not proceed with signup or use of the Service. These Terms apply instead of any separate signed agreement unless we've expressly agreed one with you in writing.

2. The Service

Boost Acquire is a done-for-you Meta advertising platform that provides Facebook and Instagram ad campaign setup and management, ad creative production, lead funnel and landing page creation, automated follow-up sequences, and access to the Boost AI CRM. The exact feature set for each plan is set out in Section 4.

Exact features, campaign scope, and support level depend on your selected plan and any add-ons agreed at signup. We may add, change, or retire features to improve the Service; we'll make reasonable efforts to notify you of changes that materially reduce functionality you're actively using.

3. Eligibility & Business Use

Boost Acquire is supplied for business use only, not to consumers for personal, domestic, or household purposes. You must be authorised to bind the business you represent to these Terms, be able to hold or obtain a Meta Business and ad account in your business's name, and the information you provide at signup must be accurate.

4. Plans & Pricing

Boost Acquire is available on two plans — Starter and Pro — billed monthly in advance, in NZD or GBP depending on your region. Current pricing for each plan is shown on our pricing page and confirmed with you before you sign up.

Prices include applicable tax (GST or the local equivalent) and are subject to change. If you're an active subscriber, we'll give you reasonable notice before a price change takes effect on your next renewal. Meta advertising spend is not included in the plan fee and is paid separately, directly by you to Meta. Boost Acquire carries no one-off setup fee.

Starter

$447 NZD/month (£197/month for UK clients). Meta (Facebook & Instagram) ad campaign setup and management, lead funnel and landing page build, automated lead follow-up sequences, access to the Boost AI CRM, and monthly reporting.

Pro

$897 NZD/month (£397/month for UK clients). Everything in Starter, plus expanded campaign management, advanced funnel and creative optimisation, and closer account management support.

5. Billing & Payment

Subscription fees are billed monthly in advance from your signup date, by automatic charge to the payment method on file.

If a payment fails, we'll attempt to retry it and notify you. We may suspend access to the Service if payment is not resolved within 7 days of the failed charge, without releasing you from amounts owed.

6. Term & Cancellation

Boost Acquire has no minimum term. You may cancel at any time by notifying us at support@boostai.co.nz or through your account manager; cancellation takes effect at the end of your current billing cycle, and you retain access until then, with no further charges after that date.

7. Refunds

Boost Acquire carries a 14-day results guarantee on your first month's fee: if your campaign generates zero leads within the first 14 calendar days of going live, and you've maintained a minimum Meta ad spend of $65 NZD (£30) per day throughout that period, completed onboarding promptly, and haven't raised a chargeback or payment dispute, you're entitled to a full refund of that first month's fee. A "lead" means a person who submits their name along with a phone number or email address via the Meta lead form or your Boost Acquire landing page. If even one lead is generated in that period, the guarantee is considered fulfilled and no refund is due.

Outside of this guarantee, monthly fees are non-refundable once a billing cycle has started, including for partial months. Meta advertising spend is never refundable by us, as it's paid directly to Meta and outside our control. This section doesn't limit any right you have under law that can't be excluded, such as guarantees under the Consumer Guarantees Act 1993 (NZ), Australian Consumer Law, or equivalent UK consumer protections, to the extent they apply to your purchase.

8. Your Responsibilities

  • Maintain a minimum Meta ad spend of $65 NZD (£30) per day so campaigns have a fair opportunity to run and optimise

  • Provide accurate business information, offer details, and the creative input or approvals we need to run your campaigns

  • Complete onboarding promptly, including granting access to Meta Business Manager and any other information reasonably requested

  • Hold any licences, registrations, or permissions your business needs to operate and to be contacted about its services

  • Follow up promptly with leads generated by your campaigns — we're not responsible for leads that go cold due to delayed or absent follow-up

  • Keep your account credentials secure and tell us promptly about any unauthorised use

9. Advertising Compliance & Consent Laws

You're responsible for ensuring your ad content, offers, and any follow-up calling, SMS, or messaging comply with applicable law in the jurisdictions where your customers are located, including unsolicited electronic messages, telemarketing, and do-not-call rules (for example, the Unsolicited Electronic Messages Act 2007 in New Zealand, the Spam Act 2003 in Australia, and UK PECR), as well as Meta's own advertising policies. We provide the platform; you're responsible for the products, services, and offers being advertised.

10. Third-Party Platforms

Boost Acquire depends on Meta (Facebook and Instagram) to deliver advertising and lead generation, and may integrate with other third-party platforms such as Google. These platforms can change, restrict, suspend, or discontinue access on their own terms, outside our control — including suspending or rejecting ad accounts or campaigns. We'll act reasonably to maintain campaigns and resolve issues with Meta on your behalf, but we don't guarantee uninterrupted availability of any third-party platform or ad account.

11. No Performance Guarantees

Beyond the 14-day guarantee in Section 7, Boost Acquire is a marketing service: results depend on factors outside our control, including your market, offer, pricing, ad spend, and Meta's own platform behaviour. We don't guarantee a specific number of leads, a particular cost per lead, or any sales, revenue, or ROI outcome, and any examples or estimates we've discussed with you are illustrative only, not commitments. Past results, including for other clients, do not guarantee future results.

12. Data & Privacy

Delivering the Service involves processing your business's customer and lead data, including names, contact details, and enquiry details, inside your CRM instance and connected ad accounts. We handle this data in line with our Privacy Policy and applicable privacy law, including the Privacy Act 2020 (NZ). You must have a lawful basis to provide us with your customers' personal information for this purpose, and you remain the data controller for that information.

13. Intellectual Property

We own the Boost AI platform, campaign templates, and general creative and funnel frameworks. You own your business data: your leads, contacts, and the specific campaigns and creative built for your account, once paid in full. On cancellation, we'll provide a reasonable window (30 days, unless otherwise agreed) to export your data before it's deleted from our systems, and campaign access on Meta's platform will be handed back or removed per your instructions.

14. Confidentiality

Each party will keep the other's non-public business information confidential and use it only to perform under these Terms, except where disclosure is required by law.

15. Liability

To the maximum extent permitted by law, our total liability arising out of or relating to the Service is limited to the fees you paid us in the 3 months before the event giving rise to the claim (excluding your Meta ad spend, which is paid directly to Meta). We're not liable for indirect or consequential loss, including lost profits or lost business opportunities. Nothing in these Terms excludes liability that can't be excluded by law.

16. Suspension & Termination

We may suspend or terminate your access if you breach these Terms, misuse the Service, or fail to pay outstanding fees, generally after notice and a reasonable chance to fix the issue, except where immediate action is needed to prevent harm or abuse — including where your Meta ad account or content is suspended or rejected by Meta in a way that prevents us delivering the Service. A chargeback or payment dispute raised against us is treated as non-payment and may result in immediate suspension until it's resolved.

17. Changes to These Terms

We may update these Terms from time to time. We'll post the updated version at this link with a new effective date, and material changes will be notified to active customers. Continued use of the Service after an update takes effect means you accept the revised Terms.

18. Governing Law & Contact

These Terms are governed by the laws of New Zealand, and each party submits to the non-exclusive jurisdiction of the New Zealand courts, regardless of where you're based.
