Boost Connect - Terms of Service

These Terms govern access to and use of Boost Connect, the AI voice, messaging, and automation platform provided by Boost Digital Ltd, trading as Boost AI ("Boost AI", "we", "us"). By signing up for, paying for, or using Boost Connect, you ("Customer", "you") agree to these Terms.
1. Acceptance of Terms
Making payment, submitting a signup form, or using any part of Boost Connect constitutes acceptance of these Terms in full. If you do not agree, do not proceed with signup or use of the Service. These Terms apply instead of any separate signed agreement unless we've expressly agreed one with you in writing.
2. The Service
Boost Connect is an AI agent platform, built on a white-labeled CRM, that provides inbound AI voice and chat coverage, reputation management, and — on Growth and Pro plans — outbound AI calling, appointment scheduling, call transfer, and system integrations. The exact feature set for each plan is set out in Section 4.
Exact channels, usage limits, and features included depend on your selected plan and any add-ons agreed at signup. We may add, change, or retire features to improve the Service; we'll make reasonable efforts to notify you of changes that materially reduce functionality you're actively using.
3. Eligibility & Business Use
Boost Connect is supplied for business use only, not to consumers for personal, domestic, or household purposes. You must be authorised to bind the business you represent to these Terms, and the information you provide at signup must be accurate.
4. Plans & Pricing
Boost Connect is available on three plans — Starter, Growth, and Pro — billed either monthly or annually in advance, in NZD or GBP depending on your region. Current pricing for each plan and billing cycle is shown on our pricing page and confirmed with you before you sign up.
Prices include applicable tax (GST or the local equivalent) and are subject to change. If you're an active subscriber, we'll give you reasonable notice before a price change takes effect on your next renewal. AI usage and telecom/call costs are not included in the plan fee and are billed separately based on usage. Some plans may carry a one-off setup fee, which will be confirmed with you before you sign up.
Starter
Inbound calls from prospects and customers; inbound coverage across web chat, Facebook, Instagram, and WhatsApp*; reputation management; voice and personality customisation; call details by email; an account manager; and monthly reports and optimisations.
Growth & Pro
Everything in Starter, plus: a CRM dashboard with call analytics; call transfer options; system integrations (CRM, JMS, PMS, and similar); appointment scheduling with calendar sync; speed-to-lead handling; and outbound AI calling (one workflow). Growth and Pro include the same features.
*WhatsApp availability may carry an additional cost.
5. Billing & Payment
Subscription fees are billed in advance from your signup date — monthly or annually, depending on the billing cycle you choose — by automatic charge to the payment method on file. Any one-off setup fee applicable to your plan is confirmed with you before signup and charged at that time, covering initial configuration of your account.
If a payment fails, we'll attempt to retry it and notify you. We may suspend access to the Service if payment is not resolved within 7 days of the failed charge, without releasing you from amounts owed.
6. Term & Cancellation
If you're on monthly billing, Boost Connect has no minimum term. You may cancel at any time by notifying us at support@boostai.co.nz or through your account manager on WhatsApp; cancellation takes effect at the end of your current billing cycle, and you retain access until then, with no further charges after that date.
If you're on annual billing, your plan is paid upfront for a 12-month term. Cancelling stops the next annual renewal but doesn't end your access, or refund any unused months, before the end of the term you've already paid for.
7. Refunds
Monthly and annual fees are non-refundable once a billing cycle has started, including for partial months or unused months of an annual term. Any one-off setup fee is non-refundable once configuration work has commenced. This section doesn't limit any right you have under law that can't be excluded, such as guarantees under the Consumer Guarantees Act 1993 (NZ), Australian Consumer Law, or equivalent UK consumer protections, to the extent they apply to your purchase.
8. Your Responsibilities
Provide accurate business information, scripts, and call-handling instructions used to configure your AI agent
Hold any licences, registrations, or permissions your business needs to operate and to be contacted about its services
Not use the Service to send unlawful, deceptive, or unsolicited communications, or to contact people who've opted out
Keep your account credentials secure and tell us promptly about any unauthorised use
9. Calling, Messaging & Consent Laws
You're responsible for ensuring your use of AI calling, SMS, and messaging complies with applicable law in the jurisdictions where your customers are located, including unsolicited electronic messages, telemarketing, and do-not-call rules (for example, the Unsolicited Electronic Messages Act 2007 in New Zealand, the Spam Act 2003 in Australia, and UK PECR). We provide the platform; you're responsible for how it's used with your contacts.
10. Third-Party Platforms
Boost Connect integrates with third-party platforms (including Meta, WhatsApp, and Google) to deliver certain channels. These platforms can change, restrict, or discontinue access on their own terms, outside our control. We'll act reasonably to maintain integrations, but we don't guarantee uninterrupted availability of any third-party channel.
11. AI Service Disclaimer
Boost Connect uses AI to handle calls, messages, and workflows. AI output can be imperfect: it may misunderstand a caller, mishandle an edge case, or make an error a human wouldn't. We work to keep quality high, but we don't guarantee specific business outcomes (such as a particular close rate, lead volume, or revenue figure), and any ROI examples we've discussed with you are illustrative estimates, not commitments. You're responsible for reviewing AI-handled interactions that matter to your business and for configuring human handoff where it's needed.
12. Data & Privacy
Delivering the Service involves processing your business's customer data, including names, contact details, call recordings, and message transcripts, inside your CRM instance. We handle this data in line with our Privacy Policy and applicable privacy law, including the Privacy Act 2020 (NZ). You must have a lawful basis to provide us with your customers' personal information for this purpose, and you remain the data controller for that information.
13. Intellectual Property
We own the Boost Connect platform, underlying software, and general automation templates. You own your business data: your contacts, call recordings, content, and the specific configuration built for your account. On cancellation, we'll provide a reasonable window (30 days, unless otherwise agreed) to export your data before it's deleted from our systems.
14. Confidentiality
Each party will keep the other's non-public business information confidential and use it only to perform under these Terms, except where disclosure is required by law.
15. Liability
To the maximum extent permitted by law, our total liability arising out of or relating to the Service is limited to the fees you paid us in the 3 months before the event giving rise to the claim. We're not liable for indirect or consequential loss, including lost profits or lost business opportunities. Nothing in these Terms excludes liability that can't be excluded by law.
16. Suspension & Termination
We may suspend or terminate your access if you breach these Terms, misuse the Service, or fail to pay outstanding fees, generally after notice and a reasonable chance to fix the issue, except where immediate action is needed to prevent harm or abuse. A chargeback or payment dispute raised against us is treated as non-payment and may result in immediate suspension until it's resolved.
17. Changes to These Terms
We may update these Terms from time to time. We'll post the updated version at this link with a new effective date, and material changes will be notified to active customers. Continued use of the Service after an update takes effect means you accept the revised Terms.
18. Governing Law & Contact
These Terms are governed by the laws of New Zealand, and each party submits to the non-exclusive jurisdiction of the New Zealand courts, regardless of where you're based.
